Class Picks: Terms & Conditions (2026)
1. Agreement
By using this website or purchasing products, you accept these terms in full. Class Picks ("the Photographer") provides photography services to school institutions and individual parents or guardians.
2. Intellectual Property & License
Copyright: Class Picks retains the legal copyright to all images.
Personal Use: Purchased digital downloads and physical prints are for personal, non-commercial use only. This includes printing for personal use and sharing on personal social media.
Prohibited Use: You must not reproduce, duplicate, copy, sell, or otherwise exploit material on our website for any commercial purpose without express written consent from the Photographer.
3. Group & Class Photographs
Safeguarding Policy: To protect student privacy and meet school safeguarding requirements, Class/Group photographs are available as physical prints only.
Digital Downloads: No digital downloads are provided for images containing multiple identifiable children from a school group.
Physical Prints: To uphold the School’s safeguarding obligations, physical prints of Class or Group photographs—which contain images of other students—are for private display only. You must not scan, photograph, or otherwise digitize these prints for the purpose of sharing them on public social media platforms.
4. Limitations of Liability
Our liability is limited and excluded to the maximum extent permitted under applicable law.
In the event of technical failure, equipment malfunction, or digital file loss, the Photographer’s liability is limited to a full refund of the fee paid for that specific service or product.
We will not be liable for any indirect or consequential loss or damage, including but not limited to: loss of profit, contracts, business, or anticipated savings.
Nothing in these terms shall exclude or limit our liability for fraud, or for death or personal injury caused by our negligence.
5. Refunds, Returns & Complaints
Custom Products: Refunds or replacements will only be issued for items that are damaged in transit or contain a printing defect.
Digital Media: Once a digital download link has been accessed or sent, it is non-refundable.
Claims & Complaints: Please notify Class Picks of any issues, defects, or complaints within 14 days of receipt.
6. Data & Privacy
Payment Security: We do not store credit card information (card numbers, expiry, or security codes). All transactions are processed via secure third-party gateways.
Privacy: Personal information is handled in accordance with our Privacy Policy and UK GDPR. Data will not be sold or disclosed to third parties unless required by law.
7. Law and Jurisdiction
These terms are governed by English Law and the exclusive jurisdiction of the courts of England and Wales.
